HIGHCOURT NOTICE TO FOREIGN MINISTERY TO FILE CASE IN INTERNATIONAL COURT TO REPATRIATION OF WAR PRISONER

Annother war prisoner, and former Indian Army official, Satish Kumar (of Ferozepur) has informed the petitioner that he was also put in Kot Lakhpat Rai Jail (in Pakistan) along with Dharam Pal Singh, where he stayed along with him from 19.7.1974 till 1976, where after he (Satish Kumar) was put in another jail. Banking upon affidavit signed by Satish Kumar, the petitioner has filed the instant Civil Writ Petition. The HC Bench has issued notice to co-prisoner, Satish Kumar also, as prayed for by the petitioner.

Punjab and Haryana Highcourt issues notice to External Affairs Ministry, in a writ petition seeking a direction to Government of India to file a case in International Court of Justice for repatriation of war prisoner-Havaldar Dharma Pal Singh of Bathinda district: Justice M.M.S Bedi today issued notices to External Affairs Ministry (Union of India) for 4.8.2017 in a writ petition filed by 78 years’ old Pal Kaur of Lehra Dhudkot (Bathinda district) who is seeking issuance of direction to the Union of India to take up the matter of release of her husband, Havaldar Dharam Pal Singh, from Pakistani jails, and also for filing appropriate proceedings, if necessary, in the International Court of Justice, for seeking his release, as a prisoner of war, under the Simla Agreement dated 2.7.1972 signed between India and Pakistan for release of the prisoners of war.

 The petitioner, in her Civil Writ Petition, filed through Advocate Hari Chand, has stated that her husband had fought in 1971 War against Pakistan on border of Bangla Desh, and was captured by Pakistan’s Army. However, the Government of India and Indian Army treated him as martyr on the basis that he was missing with effect from 5.12.1971. Even PM, Indira Gandhi wrote a personal letter to her condoling the demise of her husband, and expressing gratitude of the entire Nation for his supreme sacrifice.

According to the petitioner, now another war prisoner, and former Indian Army official, Satish Kumar (of Ferozepur) has informed the petitioner that he was also put in Kot Lakhpat Rai Jail (in Pakistan) along with Dharam Pal Singh, where he stayed along with him from 19.7.1974 till 1976, where after he (Satish Kumar) was put in another jail. Banking upon affidavit signed by Satish Kumar, the petitioner has filed the instant Civil Writ Petition. The HC Bench has issued notice to co-prisoner, Satish Kumar also, as prayed for by the petitioner. The petitioner has stated that India is entitled to approach International Court of Justice, based on provisions of Simla Pact, for seeking repatriation of her husband, as a war prisoner. He referred to the recent case of Kulbhushan Jadhav, a former Indian Navy Officer, in whose case the Government of India has approached the ICJ.
