HIGH COURT DIRECTS LOCAL GOVT. TO CONSIDER ENGINEERS ISSUES BEFORE FINALISATION OF PUNJAB MUNICIPAL BUILDING BYE-LAWS

Punjab and Haryana High Court has directed Local Govt. department to consider the various issues raised by Council of Enginèers in their representation, which may be supplemented by them,if so required, and to decide all such issues in accordance with law, before finalising the Punjab Municipal Bye Laws,2017.

Er. Kapil Arora, President, Council of Engineers informed that the High Court has passed this order as the respondents filed an affidavit in the HC assuring therein that a meeting of petitioner-association with Addl Chief Secretary, Punjab will be held on 16.9.2017 at 12.00 Noon for hearing its issues.The writ petition filed by Council of Engineers has been disposed this after noon with aforesaid directions.

Er. Arora further said that it is clear from provisions of Architects Act 1972 as well as National Building Code of India, 2016 that Engineers & Architects are equally competent for preparation of Building Plans and information connected with its permits and large no. of Engineers in Punjab are already practicing as licensed holder as an Engineer to prepare and submit building plans in Municipal Corporations & Councils. However, they were being ignored for unknown reasons at the time of finalisation of Bye-laws but with the directions of Hon'ble High Court, the Local Govt. Department will have to go by the law.

Er. Sanjay Verma, General Secretary said that Department of Housing & Urban Development, Punjab has also demanded Objections in similar manner on 08-09-2017 and council of Engineers & large no. of Engineers have started filing the objections from today with the department too.
