VALUER ASSOCIATION WELCOMES LANDMARK JUDGMENT BY HON'BLE SUPREME COURT ON TECHNICAL DEGREE

Valuers Association (Regd.) whole heartedly welcomed the landmark judgment passed on 03-11-2017 by Hon’ble Supreme Court of India in a case title “Orissa Lift Irrigation Corp. Ltd vs. Rabi Sankar Patro & ors” in a matter of Technical Education through Distance Education by universities. In this regard a meeting office bearer was held in the head office of the association on Saturday. The Hon’ble Supreme Court has clearly directed that Technical Education cannot be given through distance education and all technical degrees awarded through distance education from session 2001-05 shall stand cancelled and recalled if such degree holders do not pass the test/tests to be conducted by AICTE by May-June 2018 or on such dates as AICTE may determine. Earlier, High court of Punjab and Haryana at Chandigarh had given such decision in a case title “Kartar Singh vs. State of Punjab. The Apex Court, in the judgment has accepted the view taken by Punjab & Haryana High Court and set aside the decision of Orissa High Court.

Er. Kapil Arora, General Secretary said that there are large no. of such illegal degree holders (degree from JRN University/iase and others) registered as Valuers u/s 34AB of Wealth Tax Act, 1957 with various offices of Chief Commissioner of Income Tax at Ludhiana, Amritsar, Chandigarh and Panchkula.

Earlier, Team of Valuers Association, as per the directions of Hon’ble High Court of Punjab and Haryana, after examining the records of large no. of Valuers at CCIT Ludhiana and Panchkula, has submitted many representations with request to remove all such fake/illegal degree holders from the list of Approved Valuers u/s 34AB of Wealth Tax Act, 1957 by CCIT.

However, no action was taken by them till date. Such persons with fake/illegal degrees are also empanelled with various banks like State Bank of India, Oriental Bank of Commerce, Allahabad Bank, Bank of India etc. Since the matter is directly connected with Indian Economy as public money is disbursed by banks based on value of property in valuation report issued by Valuers, Valuers Association had given representation to all such banks too but banks too has not taken action against them.

Er. Arora further said that with the landmark judgment given by Apex court, all such departments will have no choice but to remove them from their panel of Approved Valuers. To safeguard the larger Public Interest, based on above landmark judgment, Valuers Association will follow up and keep check on all registered Valuers with all departments including banks so as to eradicate all fake/illegal degree holders.
Col. Bakshi, Chairman, Chandigarh Chapter said that genuine technical degree holders in Govt. departments were facing problems of lesser or delayed opportunity in their promotions due to such fake degree holders. Now the system will be clean and safe for genuine technical degree holders.
