The defence in the much hyped Varnika Kundu case continued to corner senior Haryana cadre IAS officer VS Kundu, father of complainant Varnika Kundu, with the political conspiracy theory, fabrication of documents and undue use of influence. VS Kundu’s cross examination concluded in the trail court on Tuesday. The next date of hearing in the case has been fixed for Feb 20.

As ordered by the court in the last hearing the case file containing the email sent by Varnika to her father VS Kundu, which reportedly carried details of the transcript of the conversation between Varnika and the police control room on the date of the alleged incident, was presented in the court on Tuesday. The email as an exhibit was vehemently opposed by the prosecution but the judge disallowed all objections and allowed the email as an exhibit in the case file.

Defence counsel Rabindra Pandit maintained in the court on Tuesday that the contents of the email were a fabrication of the reported conversation between Varnika and the police control room and the investigating agency was influenced to work on these lines.

The defence lawyer also pressed home the political influence in this case when he got VS Kundu to admit that former Haryana Minister in the Congress regime Mani Ram Godara was related to him.

The defence also maintained that the SIT chief appointed in the case Satish Kumar is a son-in-law of Rajeev Singh Dalal, Haryana DGP during the Bhupinder Singh Hooda led Congress government in the state. VS Kundu and Rajeev Singh Dalal also had a close association because of their being together at the Lal Bahadur Shastri National Academy of Administration (LBSNAA) in Mussoorie, he asserted.

VS Kundu has already admitted in court that during the initial hours and days of the case he has had telephonic conversations with the UT Home Secretary Anurag Aggarwal, who supervises the functioning of the Chandigarh Police, and UT deputy Commissioner Ajit Balaji Joshi. Both are Haryana cadre officers much junior to VS Kundu. He has also admitted having telephonic conversations with a host of senior IAS or retired IAS officers of Haryana cadre, besides former Congress chief minister of Haryana Bhupinder Singh Hooda and INLD leader and Leader of the Opposition in the state assembly Abhey Singh Chautala.

The defence counsel has attacked him for misusing his bureaucratic and political influence to fabricate serious non-bailable charges against the accused for political considerations.

Both accused in the case, Vikas and Ashish Kumar, have pleaded innocence in the case. Vikas has since been bailed out by the high court.
