PRACTISING LAWYERS IN PUNJAB, HARYANA AND UT TO AFFIX ADVOCATES WELFARE FUND STAMP ON EVERY MEMO AND VAKALATNAMA

Today, the Chairman Bar Council convened a meeting of the members of Bar Council to pay thanks to Hon’ble Chief Justice and companion judges of Punjab and Haryana High Court to express its gratitude and thanks for issuance of notification making amendments in  High Court Rules and Order for the fixation of Welfare Stamps on the Vakalatanama.

All the Advocates practising in the States of Punjab, Haryana, U.T. Chandigarh shall be required to affix Advocates Welfare Fund Stamp, on every Vakalatnama/Memo of Appearance and written authorization. It has been made possible with the amendment in the High Court Rules and Orders vide notification dated 15.3.2018. 

This was stated by Dr. Vijender Singh Ahlawat, Chairman of the Bar Council of Punjab and Haryana, Chandigarh. Today, the Chairman Bar Council convened a meeting of the members of Bar Council to pay thanks to Hon’ble Chief Justice and companion judges of Punjab and Haryana High Court to express its gratitude and thanks for issuance of notification making amendments in  High Court Rules and Order for the fixation of Welfare Stamps on the Vakalatanama.

The said meeting was attended by S/Shri Vijender Singh Ahlawat, Chairman, Rajeev Kaswan, Vice Chairman Harpreet Singh Brar, Hony Secretary, Sh. Amit Rana, Co-Chairman BCI, Sh. Harpreet Singh Garcha, Co-Chairman, BCPH,  Sh. Jai Vir Yadav, Chairman Advocate Welfare Fund Committee, Sh. Karanjit Singh, former Vice Chairman, Sh. R.S. Badhran, Chairman Administrative Committee, Sh. Partap Singh, Chairman Executive Committee, Sh. Rakesh Gupta, Former Chairman, Sh. Lokesh Sinhal, Member Bar Council and other members of the Bar Council. For carrying out necessary amendment in its Rules and orders for accepting the request of the Bar Council for the proper implementation of the Welfare Schemes for the Advocates under the Advocate Welfare Fund Act.  Under the provisions of Advocate Welfare Act of the Advocates Practising before Punjab and Haryana High Court, District and Subordinate Courts in the States of Punjab, Haryana and U.T. Chandigarh and also before Tribunals, Commissions, Forums, Quashi Judicial Authorities would be required to affix the requisite Advocates Welfare Stamp on every Vakalatnama, memo of appearance and written authorization.  It may be mentioned that the Advocates Welfare fund Stamps in the States of Haryana and U.T. Chandigarh shall be of Rs. 25/- and in the State of  Punjab the same would be of Rs. 15/-.  The corpus which would be created by the affixation of Advocate Welfare Stamps shall be utilized only for the various welfares schemes as envisaged under the Act/ Rules which includes Financial Assistance  for medical treatment/operation as well as Financial Assistance in case of cessation/retirement from the legal profession.

 There is a provisions for providing Financial Assistance in the tune of Rs. 1.50 lac to 4.50 lac to the dependents of the Advocates in case of death. The benefit of the schemes would be admissible to the advocates who are enrolled with the Bar  Council of Punjab and Haryana and become the member of the Trustee Committee under the Advocate Welfare Fund Act.  The Trustee Committee notified under the respective Acts for the States of Punjab, Haryana and U.T.  Chandigarh respectively would be responsible for the proper implementation of the Welfare Schemes under the Welfare Act.  As per the notification issued by the Punjab and Haryana High court, the necessary amendments have been made in rule 4 Chapter 25 part A , Volume III, Rule 10 of Chapter I Part –B Volume I and Rules 6 of Chapter VI part –B of volume IV of the rule and orders of the Punjab and Haryana High Court. The Bar Council of Punjab & Haryana has issued letter to all the Bar Associations throughout the States of Punjab, Haryana and U.T. Chandigarh for affixation of the  Advocates Welfare Stamps with immediate effect.  The Bar Council has made strenuous efforts for the implementation of the Advocates Welfare Fund Act since 2008 and it has been fruitified  now. Chairman said that stamps has already printed and available in the Bar Council, the concerned Bar association may collect the same from the Bar Council.
