REVISED PARKING FEE - ENGINEERS SEEKS TRANSFER OF MC COMMISSIONER

Council of Engineers through their advocate Sh. HC Arora has sent legal notice to the Chief Minister, the Chief Secretary, the Principal Secretary Minister of Local Bodies & DC Ludhiana with demand to transfer Ms. Kanwalpreet Brar from the post of Municipal Commissioner of Ludhiana as well as to withdraw the decision of increas in parking fee by MCL. 

Association President, Er. Kapil Arora informed that Ms. Kanwalpreet Brar had earlier allotted the parking contract to M/s Jugnu Engg., M/s Arjun Yadav & Co. and LRY Company in August 2018 by favoring them by imposing condition of having atleast one year experience of managing parking lots of Rs 25 Lakhs contract amount in past three years to become eligible in the tender. Ms. Kanwalpreet Brar issued to contracts to all the three companies without getting final approval from Finance & Contract Committee i.e. without following the mandate as enshrined under section 42 (4) of Punjab Municipal Act, 1976 in which it is well defined that the F & CC Committee shall exercise all the powers of the Corporation in relation to contracts to be entered into for and on its behalf and the purchases so be made by it. 

Er. Kapil Arora further added that In case the addressees/departments do not take appropriate steps within 7 days i.e. by 11-02-2019 to transfer Ms. Kanwalpreet Brar and if parking charges as increased by MC Ludhiana are not withdrawn, in that event, we will file a Public Interest Litigation in the Hon’ble Punjab and Haryana High Court at Chandigarh for redressal of our legitimate grievance mentioned above.

Er. Kulwant Singh Rai, Sr. Vice President informed that despite receiving various complaints of illegal overcharging by parking contractors from CoE as well as matter highlighted by various renowned newspapers, the MC Commissioner & concerned officials didn’t move an inch. Only after filing of complaints with Vigilance department against MC Commissioner & other unknown officials by CoE, the department woke up from deep slumber and sting operation was conducted by MCL in which they caught red handed all the three parking contractor overcharging from public. MC Commissioner rather than terminating the contract, sent the proposal of cancellation of Parking Contracts to F & CC Committee in order to linger-on/delay the action on matter and to allow parking contractor to continue to loot the harden earned money of Public by overcharging from them and the loot by parking contractors continued. 

Er. Mohit Jain, Vice President informed that after long time of around 75 days of forwarding the proposal of cancellation of Parking Contracts, the parking contracts came to an end on 25-01-2019 but no legal documentation of signing of MoU was done at the time of allotment of contract by MC Commissioner just to save the parking contractors from being blacklisted as it was well in mind of MC Commissioner that they will definitely start overcharging illegally and in case of any complaint, they will have excuse of not having MoU with all three. 

Er. Sanjay Verma, General Secretary said that illegally activities were being carried out by parking contractors for last six months under the very nose of Ms. Kanwalpreet Brar despite receiving various complaints and matter highlighted by all the renowned newspaper since the allotment of parking contracts, Ms. Kanwalpreet Brar has committed criminal negligence towards performance of her duty as MC Commissioner of Ludhiana. Now the decision of increase in Parking Fee is very harsh, unlawful & against larger Public Interest as such decision taken by MC Commissioner is just an act to legalize the illegal activities earlier done by the parking contractors to give monetary benefit to few parking contractors only. 

Er.
