ILLEGAL ONGOING CONSTRTUCTIONS: ENGINEERS FILES COMPLAINT AGAINST MCL, GLADA AND LIT OFFICIALS

Council of Engineers has filed complaint against concerned Assistant Town Planners, Municipal Town Planner, Building Inspectors and unknown persons of Municipal Corporation Ludhiana, GLADA & Improvement Trust Ludhiana for their Gross Criminal negligence and active connivance with the violators due to which large number of Illegal Constructions are going on in entire Ludhiana. The complaint has been filed with the CM, Chief Secretary, Principal Secretary of Local Government Department, Additional Chief Secretary of PUDA and DC, Ludhiana.

Er. Kapil Arora, President informed that despite introduction of Building Bye-laws from time to time, the violations have continued due to active connivance of such corrupt officials and the condition of Ludhiana has worsened with time. For better development of Ludhiana, Punjab Government introduced PAPRA Act in year 1995 and to have better society to live, Punjab Model Building Bye-laws were introduced in year 1997. However, due to gross negligence as well as in active connivance with the owners of the buildings by concerned Assistant Town Planners, Municipal Town Planner, Building Inspectors and unknown persons of Municipal Corporation Ludhiana, GLADA & Improvement Trust Ludhiana, these laws have proved to be toothless tiger and the condition of all the colonies (developed by Local Bodies and Approved/unapproved) has worsened with the time. GLADA & MCL have not only failed in keeping check on illegal colonies but also have failed in taking action against illegal construction vis a vis prevailing building byelaws. 

Er. Er. Sunil Puri, Vice President informed that almost 90% of buildings in colonies developed by Private Colonisers are being constructed with 100% coverage & projections above the roads. One of such colony situated at Rahon Road is Bhagya Homes which comes under the jurisdiction of MCL. Similarly almost 75% of buildings constructed in new colonies under the jurisdiction of GLADA have been constructed against violations and further illegal construction of new buildings are still in progress in these colonies. Best example is under construction Industrial buildings at Bajra Road as well as Seeran Road at Main Rahon Road Ludhiana.

Er. Kulwant Singh Rai, Sr. Vice President informed that many constructions are going on at upper floors of existing buildings too. Such buildings are old and foundations of these buildings is not designed to bear load coming over it due to new construction. Such buildings are not structurally safe and can collapse at any time which may result into fatal injury and damage to nearby buildings. It is pertinent to mention here that MCL has made no provisions of submission of Structural Safety Certificates in Online Building Plan System. It is well known fact that Punjab falls in Zone 4 as per IS Codes which means, Punjab is very at high level of seismicity. The illegal buildings are like time bomb for Ludhiana. 

Er. Mohit Jain, Vice President & Er. Punjab Singh said that on one side, department raises issue of fire safety but there is no check on such major issue and most of the buildings have no fire safety measures too. Already Ludhiana has faced major incident of fire at Sufian Chowk in which large number of people died which included staff of MC fire departments too. MCL, GLADA & LIT hasn’t learnt from such incidents and is permitting violations in Ludhiana. The personal benefits of concerned officials for permitting such unlawful activities cannot be denied which is a matter of investigation. 

Er. Sanjay Verma, General Secretary informed that irresponsible behavior of concerned officials of MCL, LIT & GLADA will continue to disobey directions as law as their irregularities have always been covered by Govt. of Punjab by introducing One Time Settlement Policies. Introduction of such policies have resulted into boosting their morale of Illegal Acts since last one decade. We have demanded strict action against the concerned officials of MCL, GLADA and LIT for disobeying directions of law. Now the Govt. of Punjab is again going to introduce such policy under the shadow of which the corrupt officials want to regularize the ongoing illegal construction too. However Council of Engineers will challenge such policy and they have already sent legal notice to the concerned departments through their counsel Adv. Sh. HC Arora.
