DESPITE APEX COURT’S DIRECTION, VIOLATION CONTINUES IN POND LAND ENCROACHMENT IN CM CITY KARNAL

 Despite the direction of Supreme Court for ‘Status-quo’ vide Order dated: 03.07.2019, the encroachment of Pond (admeasuring 65 Kanals in Khasra No. 67) was continued and Karnal administration became a mute spectator. 

Even after the said Order of SC, sitting MLA Bakshish Singh Virk inaugurated the Luhar Chaupal on the disputed pond land. After receiving the third legal notice, Karnal District Administration suspended Sarpanch Sanjana Devi and Village Secretary Anand Hooda. But after two earlier notices (08.07.2019 & 26.07.2019) to comply with the said Order of SC, Karnal Administration failed to stop the constructions. In another filed through Sh. Rajesh Gupta, Advocate in Punjab & Haryana High Court, the High Court has vide Order dated: 05.09.2019 directed the Karnal District Administration to file the status report by December 5 after getting removed the encroachments done on Panchayat Land and Canal Irrigation System Lands by Sarpanch, her husband Praveen Narwal and other family members and other villagers.  

Advocate Shailender Mohan alleged that not only the Sarpanch and her husband encroached the pond by filling into pond the rice husk ash derived from Chaman Lal Setia Rice Mill and other local rice mills but also, allotted unauthorized 170 plots on eight acres of Pond Land in Khasra No. 67 in gross violation of Order dated: 04.07.2014 earlier passed by the erstwhile DC-Karnal in year 2014 who ordered for shifting of these plots in alternate Land in Khasra No. 55. 

The Petitioner, Bijender Singh, a farmer has filed a Civil Appeal in Supreme Court which is pending.   

While talking to the reporters on Monday at Chandigarh Press Club, advocate Shailender Mohan, who is fighting for removal of encroachment from Pond Land, told that he had complaind to district administration, Chief Minister, local MLA, Chief Secretary and Panchayat Department but no action has been taken so far. The doors of NGT were also knocked but no solid direction had been issued. The Apex court while hearing in this regard, had issued, vide its Order dated: 03.07.2019 notice to all respondents including Sarpanch, Gram Panchayat-Chirao, DC- Karnal, Chief Secretary, Vijay Setia etc and direction for status quo, but despite of the said Order, the encroachment and construction on Pond Land was going on. Acting in gross disobedience of the said order of SC, the Sarpanch Sanjana Devi on 09.08.2019 in presence of her husband, Gram Sachiv, BDPO-Nissing and other members of Gram Panchayat, got inaugurated by local sitting MLA Bakshish Singh Virk the Luhar Chaupal constructed on said Pond Land  

Advocate Shailender Mohan alleged that not only the Sarpanch and her husband encroached the pond by filling into pond the rice husk ash derived from Chaman Lal Setia Rice Mill and other local rice mills but also, allotted unauthorized 170 plots on eight acres of Pond Land in Khasra No. 67 in gross violation of Order dated: 04.07.2014 earlier passed by the erstwhile DC-Karnal in year 2014 who ordered for shifting of these plots in alternate Land in Khasra No. 55. But since year 2016, acting in collusion with Administrative Officers and officer of Development & Panchayat Deptt Sarpanch and her husband Praveen Narwal encroached 65 kanal of pond land. But no action was taken by Administration. Directions were issued by the Punjab & Haryana High Court to the Karnal District Administration after knocking the door of court by complainant Bijender Singh in year 2016.  

The complainant filed Contempt Petition when district administration refused to follow the direction of High Court. Afterwards, the district administration filed misleading affidavit in the court asking that there was no pond at the site of plotting in the village Chirao. The court disposed-off the petition suggesting complainant to challenge the administration's reports.  

Complainant got no justice even filing the appeal to Commissioner, Financial Commissioner and Secretary of Panchayat after challenging the report issued by Karnal district Administration. 

In its reply to the petition, the Sarpanch of village, DC-Karnal and other respondents including Mr, Vijay Setia confessed that waste of rice mills had been put into the ponds and spent Rs 4 lacs on it. Sarpanch, District Administration and others also admitted illegal plotting and constructions on the Pond Land.  

Despite the non-compliance of direction of Supreme Court, legal notice was sent to district administration but in vain. The District Administration had issued notices to the Sarpanch, Gram Sachiv and BDPO regarding dis-obedience of SC Order and asked them to appear for reply on 24.09.2019. Sarpanch Sanjana Devi remained absent and then Sarpanch and Gram Sachiv Anand Hooda were suspended.

Advocate Shalander Mohan alleged that even Chief Minister did not give time to him despite his efforts and MLA also did not take any action in this regard.  

He demanded removal of encroachment from the Pond Land, and registration of cases against Sarpanch Sanjana Devi (suspended), her husband Praveen Narwal, Mr. Vijay Setia, (Director- Chaman Lal Setia Rice Mill, Karnal) and other culprits responsible for dumping rice husk ash into pond,, encroachment of pond and embezzlement of Panchayat Funds.
