MAYOR ELECTION: DISTRICT MAGISTRATE ISSUED PROHIBITORY ORDERS ON GATHERING OF 5 OR MORE PEOPLE AROUND MC BUILDING

Whereas, the election of Mayor, Senior Deputy Mayor and Deputy Mayor of Chandigarh Municipal Corporation shall be conducted on 30.01.2025 at the Municipal Corporation Building, Sector-17, Chandigarh and there is an apprehension that some groups may cause obstruction, annoyance or injury to the persons lawfully employed or other general public and endanger human life and property, disturb public peace and tranquility and cause riots and affray.

Nishant Kumar Yadav, I.A.S., District Magistrate, U.T. Chandigarh, in his  opinion that the gathering/assembly of 5 or more people etc. in and around the Municipal Corporation Building, Sector-17, Chandigarh during the election of Mayor, Senior Deputy Mayor and Deputy Mayor on 30.01.2025, may cause obstruction, annoyance or injury to persons lawfully employed or other general public, disturb public peace and tranquility and cause riots and affrays and that immediate action is necessary for the prevention of the same.

Now therefore, I, Nishant Kumar Yadav, I.A.S., District Magistrate, U.T. Chandigarh, in exercise of the power vested under section 163 of the Bhartiya Nagrik Suraksha Sanhita-2023, do hereby order as a measure of emergency that any gathering/assembly of 05 or more persons in the Municipal Corporation Building, Sector-17, Chandigarh and within 100 meter from its periphery is prohibited w.e.f 29.01.2025 to 30.01.2025.

Provided that the above order shall not apply to:-

(1) The police or Para-military or military persons or any other Government servant on official duties;

This order shall come into force from zero hours on 29.01.2025 and shall be effective up to 12:00 midnight of 30.01.2025.

In view of the emergent nature of the order, it is being issued ex-parte and is addressed to the public in general. Any breach of this order would invite action under section 223 of Bhartiya Nyaya Sanhita, 2023 and other relevant provisions of law.

This order shall be promulgated by affixing copy thereof at the Notice Boards of the office of the undersigned as well as the District Courts, Chandigarh and publication in the newspapers having circulation in the area, through the office of the D.P.R., Chandigarh.
