A senior citizen and allottee of the Purab Premium Apartments, Sector 88, Mohali, has submitted a detailed representation to the Chief Justice of the Punjab & Haryana High Court, Chief Justice of Apex Court, Governor of Punjab and President of India,seeking suo motu cognisance of alleged irregularities, corruption and violations in the GMADA housing project.
In her representation, Gurvinder Kaur, Retd. Sr citizen and office bearer of Office bearer of association ‘PURAB PREMIUM APPARTMENTS JAN-HIT BACHAO COMMITTEE’ and a a resident of Phase-II, Urban Estate, Patiala, has requested the High Court to intervene in what she describes as a case involving alleged cheating of homebuyers, denial of promised facilities, and violations of statutory and constitutional provisions.
The complaint states that the Punjab Vigilance Bureau is reportedly seeking approval from the competent authority to register an FIR under the Prevention of Corruption Act against former GMADA Chief Administrator Sarvjit Singh (IAS, 1992 batch) and former GMADA Estate Officer (Housing) Mahesh Bansal, in connection with the matter.
According to the representation, despite taking possession of the apartments, several essential statutory approvals and promised amenities are allegedly still pending.
The complainant has alleged that:
*The promised 690 sq. ft. basement car parking, which formed part of the allotment brochure and agreement, has not been handed over even after several years.
*The project allegedly does not possess a valid Fire No Objection Certificate (Fire NOC), posing a serious risk to residents and allegedly violating the fundamental right to life under Article 21 of the Constitution.
*An Occupancy Certificate (OC) has allegedly not been issued, despite possession being offered.
*Possession was allegedly handed over in violation of legal requirements, with reference made to the Supreme Court judgment in Dharmendra Sharma vs. Agra Development Authority (Civil Appeal No. 6344 of 2024), decided on September 6, 2024.
The complainant has further alleged the use of substandard construction materials, including lower-height stainless-steel railings, ceramic tiles instead of premium vitrified tiles, persistent leakages and structural defects, resulting in alleged infringement of property rights guaranteed under Article 300A of the Constitution.
It has also been alleged that the contractor, Simplex Infrastructure Ltd., withdrew from the project in 2020, but no FIR has been registered against its directors or project officials despite allegations of large-scale financial irregularities.
The representation further claims that a medical college hostel is functioning within one of the project blocks despite the alleged absence of a Fire NOC, thereby allegedly endangering students. Another allegation states that the project’s site layout was altered from the originally proposed location to benefit a private builder, allegedly causing financial loss to homebuyers.
The complainant has also alleged that the promised 1.4-mile walking track spread over approximately 4.5 to 5 acres has not been developed and that a portion of prime land has allegedly been allotted to Punjab State Power Corporation Limited (PSPCL) without obtaining the consent of the required majority of homebuyers.
Questions have also been raised regarding the project’s RERA registration, expiry of the registration, and the alleged absence of proper escrow account compliance.
In the representation, Gurvinder Kaur has urged the High Court to constitute a Special Investigation Team (SIT) and appoint a Forensic Audit Committee to investigate the alleged financial and administrative irregularities in the project.
She has also sought directions to GMADA to withdraw the earlier possession letters and issue fresh possession only after obtaining all mandatory approvals, including the Fire NOC, Occupancy Certificate, RERA compliance and completion of all promised facilities.
According to written communication received to Gurvinder Kaur from Principal Secretary Housing Urban Deptt. Punjab on direction of Hon’ble Governor, has taken up the matter with Chief Administrator GMADA for further action.
