Economic Offences Wing, Delhi Police has arrested two accused persons 1. Sunil Dahiya s/o Lt. Daryo Singh R/o o H-211, Jalvayu Tower, Sector- 56, Gurgaon, Haryana, Age 49 Years 2. Sanjay Dahiyas/o Lt. Daryo Singh R/o H-211, Jalvayu Tower, Sector- 56, Gurgaon, Haryana, Age 44 Years in case FIR NO. 105/19 14.06.2019 U/s 409/420/120B IPC, PS EOW for cheating the complainant by way of committing Assured return on booking in their Cyber park Project.
The complainant Mrs Sharda Choudhary has alleged that she made the entire sale consideration on the representation and assurance of the accused directors of M/s Vigneshwara Developwell Pvt. Ltd. namely Daryao Singh, Sunil Dahiya & Sanjay Dahiya that possession of the allotted units in the Cyber Park project being developed at Sector-74, Gurgaon, Haryana, will be handed over within five years and till then assured return of @ Rs 120 per Sq Feet/month will be paid to the investors. She invested in the project amount of Rs 70 Lacs for the two units in the project on the assurance of the developers and agreements were prepared on 14.04.2012 and 17.04.2012. But despite lapse of 4-5 years, possession of the unit has not been offered. The assured return cheque has started getting dishonoured. The directors of the accused company misappropriated the amount received from the complainant in the name of developing the project. Thus the alleged persons cheated her and misappropriated her hard earned money.
During the course of investigation it was revealed that all accused persons became directors in one Vigneshwara Developers Pvt. Ltd. After sometime, they incorporated 15 more companies but management of all the companies remained common and being run from the same address. A project was launched by Vigneshwara Group of Companies at Sector 74, Gurgaon, Haryana.
On the site inspection, it has been found that there has been no construction activity on this site except digging of a ditch. The general public was assured that possession would be handed over within the five years. However, despite the lapse of nine years, construction is yet to start. On scrutinizing the bank accounts of M/s Vigneshwara Developers Pvt. Ltd., it has been found that huge amounts were transferred into the individual account of father of the accused persons and also into the account of sole proprietorship firm of Daryao Singh(expired). Further, the accused persons Sunil Dahiya & his brother Sanjay Dahiya also received amount from the company’s bank account.
MODUS OPERANDI: Mr. Jitendra Kumar Meena , IPS, DCP said, accused person depicted a rosy picture to the investors and allured the complainants on the pretext of assured return.
ARREST:- On 29.08.2022, accused persons 1. Sunil Dahiya s/o Lt. Daryo Singh R/o H-211, Jalvayu Tower, Sector- 56, Gurgaon, Haryana, Age 49 Years 2. Sanjay Dahiyas/o Lt. Daryo Singh R/o H-211, Jalvayu Tower, Sector- 56, Gurgaon, Haryana, Age 44 Years have been arrested by Inspector Pankaj Kumar. During further investigation PC Remand of the accused Sunil Dahiya and sanjay Dahiya were obtained.
Accused Sunil Dahiya is a Science Graduate from Elphinstone College, Bombay. He was working as Assistant Manager, Cargo Sales Linex, a subsidiary of Cathay Pacific Airlines, Hongkong. After that he left his job and planned to develop a Cyber Park Project with the help of his father Daryon Singh and brother Co-accused Sanjay Dahiya. He formed the companies, purchased land in Haryana and started collecting money from the investor inducing them for Assured return and lucrative profit. He is found involved in several more cases registered in Delhi and Haryana. Further Investigation of the case is in progress
Accused Sanjay Dahiya is also a Science Graduate from Elphinstone College, Bombay. He was working as Director in accused company and involved with the co-accused in the crime.
