RTE ACT 2009 UPHOLDS EQUALITY AND FRATERNITY AND DIMINISH SOCIETAL DISPARITIES: DR. RAJU

DR. JAGMOHAN SINGH RAJU’S TIRELESS EFFORTS SECURE LANDMARK VICTORY FOR UNDERPRIVILEGED CHILDREN

In a resounding win for social justice and education reforms, Dr. Jagmohan Singh Raju’s relentless advocacy has led to a landmark ruling by the Punjab & Haryana High Court enforcing the Right to Education (RTE) Act, 2009. The Court has directed all private unaided schools in Punjab to reserve 25% of Class I seats for children from weaker sections, ensuring their fundamental right to free and quality education.

Dr. Raju, a former IAS officer and educationist has asserted that this interim order passed by Honourable Chief Justice Sheel Nagu and Justice Harmeet Singh Grewal upholds the constitutional values of social justice, equality and fraternity besides diminishing societal disparities.

Dr Raju spearheaded the legal battle by filing a Public Interest Litigation (PIL) on 20 December 2024 which challenges constitutional validity of Punjab Government’s Rule 7 (4) of the RTE Rules 2011. His persistent efforts exposed systemic barriers that had deprived thousands of children of their rightful education. The Honourable High Court concurred with his argument, striking down the rule as contrary to Section 12(1)(c) of the RTE Act.

(SUBHEAD)Speaking on the Honourable High Court’s path breaking ruling, Dr. Raju remarked, “This interim order is not just a legal triumph but a moral victory for every child who had been denied his right to education due to financial constraints. The Honourable Court has given a glimmer of hope to marginalized children. It is imperative that the authorities ensure full compliance of the Honourable High Court’s interim order.”

Adv. Krishna Dayama, Trustee, KS Raju Legal Trust asserted that the Trust decided to file this PIL as lack of implementation of the RTE Act in Punjab had deprived thousands of underprivileged Children of their Right to Education.

Dr. Raju has now called for strict enforcement mechanisms to guarantee the implementation of this interim order , urging both government officials and civil society to actively monitor compliance.

Dr. Raju is now focused on ensuring that eligible children and their families are aware of their rights and can claim their rightful admissions. He is also pushing for greater transparency in the admission process and stronger monitoring mechanisms to prevent any attempts at evasion by private schools.
