THREE MONTHS AFTER COMPLAINT TO SSP OFFICE, SENIOR CITIZENS SEEK FIR AND FAIR INVESTIGATION

In connection with an alleged fraudulent and illegal transfer/sale of flats associated with M/s Royale Empire, Peer Muchalla, Zirakpur, complainants Rajinder Singh Bajwa, Flat No. 304, Block-C, and Krishan Avtar Joshi, Flat No. 303, Block-F, have raised serious questions over the delay in police action.
The complainants stated that they are senior citizens and that a written complaint was submitted to the SSP office nearly three months ago, but the matter has not progressed with the urgency they expected.

According to the complainants, they had paid the entire sale consideration for the respective flats and the properties had been duly allotted in their names. However, they allege that despite the allotment and full payment, the same flats were subsequently sought to be transferred or sold to third parties.

The complainants have demanded a fair, impartial and document-based investigation into the matter and have sought registration of an FIR if the allegations and evidence disclose cognizable offences.

Questions Raised Over Allotment, Payment and Alleged Transfer

Rajinder Singh Bajwa and Krishan Avtar Joshi said that several months have passed since their complaint was submitted to the SSP office, but they are still awaiting effective action.

They further alleged that, despite being senior citizens, they have repeatedly been called to police offices in connection with the complaint, causing them mental stress and inconvenience. The complainants have requested the police authorities to take their age and circumstances into consideration and, instead of repeatedly calling them, examine the available documents, records and evidence and proceed with the investigation in accordance with law.

They stated that they possess documents relating to the allotment and payments made for the flats. They have sought detailed verification of the original allotment documents, payment records, agreements, transfer/sale documents, project records and the role of all persons connected with the transactions.

The complainants have alleged that Prince Garg, Nikita Garg and Anju Singla, wife of Late Shri Jeevan Garg, were involved in the matter and have requested that, if the investigation establishes any instance of fraud, breach of trust, forgery, use of allegedly forged documents or any other legal violation, appropriate action be taken against the persons found responsible, strictly in accordance with law.

Questions Raised Over Registry of Approximately 2,500 Sq. Yards of Land

The complainants have also sought an investigation into another aspect allegedly connected with the matter involving approximately 2,500 square yards of land.

They alleged that after the project had been approved, the said land was purchased for approximately ₹77 lakh and registered in the name of Nikita Garg, and that it was subsequently sold for an amount allegedly close to ₹20 crore. The complainants have raised questions regarding the transaction and have alleged that there may have been a loss of government revenue, which, according to them, should be examined by the competent authorities.They have therefore demanded verification of the land registry, ownership records, project approvals, revenue records, consideration paid, subsequent transactions and all related financial and property documents.

They said that the circumstances and basis on which the approximately 2,500-square-yard property was registered after project approval should be thoroughly examined so that the complete facts can be established.

Other Flat Buyers Also Raise Concerns

Other flat holders associated with the matter, including Sandeep Kataria, Flat No. 401, Block-F, and Sheel Kaushik, Flat No. 503, Block-C, have also expressed concerns regarding the status of their properties and the rights of the flat holders.

Sandeep Kataria said that the documents relating to the flats and the legal status of the rights of the respective flat holders should also form part of the investigation. He said that if any irregularity has taken place in the allotment, payment or transfer process of any flat, the relevant records should be independently examined and the actual position established.

Sheel Kaushik said that flat buyers had invested their hard-earned money in the properties and deserved clarity regarding the status of their flats and investments. He appealed to the authorities to conduct a fair and transparent investigation and ensure that affected persons receive justice in accordance with law.

Demand for FIR and Time-Bound Investigation

Rajinder Singh Bajwa and Krishan Avtar Joshi clarified that their objective is not to declare anyone guilty without investigation. They said they only want the documents and evidence submitted by them to be properly examined and, if the allegations are found to be substantiated, appropriate legal action should follow.

They have appealed to senior police officials to take immediate cognizance of the complaint submitted to the SSP office and ensure a fair, impartial and time-bound investigation, including examination of the alleged transfer/sale of the flats and the records relating to the approximately 2,500-square-yard land transaction.

The complainants reiterated that they are senior citizens and have been waiting for a resolution for several months. They requested that, instead of repeatedly calling them to offices, the authorities should examine the available documentary evidence and take the legal process forward at the earliest.

They expressed hope that the authorities would ensure a fair investigation and that, if the role of any individual is established during the investigation, appropriate action would be taken strictly in accordance with law.
