PUNJAB EXCISE DEPTT INSPECTS HARTEK POWER LIMITED FOR TAX EVASION IN CRORES, BEGINS INVESTIGATION

THE DEPARTMENT TAKES ACTION AFTER RECEIVING COMPLAINTS FOR ISSUING BOGUS E -WAY BILLS FOR TRANSPORTATION

The Excise and Taxation Department of Government of Punjab has carried out an inspection of M/s Hartek Power Private Limited F-321 Industrial Focal Point Phase 8 B SAS Nagar Mohali after receiving complaints of tax evasions in crores.

The inspection was carried out as per the provision of the section 67 of the Punjab Goods and Service Tax Act 2007/ Central Goods and Service Tax Act 2017.The Department has started the investigation of the matter. The department has taken the action on the complaint filed by Kulbir Singh proprietor of Arvindra Electricals sector 44 Chandigarh .

(MOREPIC1)(SUBHEAD)In the complaint made to Assistant Excise and Taxation Commissioner State Goods and Service Tax Department Sector 69 SAS Nagar Mohali Kulbir Singh said that they had purchased electrical equipment amount to Rs 11 Crores for an ongoing GMADA project at Mohali from Siemens authorized dealer Ms Hartek Power Pvt Ltd in March 2023.

The dealer issued bogus, fake and invalid invoices, E way bills primarily for the purpose of tax evasion. Kulbir Singh says that he is doing the business of Electrical Contractor Chandigarh, Haryana and Punjab etc. He has procured the electrical works in Punjab. He has entered into an agreement for purchase of material for execution of electrical contract in the contactee department with M/s Hartek Power Pvt. Ltd.

During the agreement time he found that M/s Hartek Power Pvt. Ltd. has violated the terms and conditions enumerated in the purchase agreement. Besides that, this firm has indulged in illegal activities and tried to deceive him by issuing bogus, fake and self contradictory invoices/E-way bills and goods receipts against the material supplied to him.

When he started the scrutiny of the invoices issued by Ms Hartek Power Pvt. Ltd. along with other documents, which is mandatory to justify the claim of legal transaction, he found serious lapse, which resulted into bogus and fake documents. The serious lapse in the documents is that this firm has issued invoices in favour of the applicant without any possession of the goods and also generated the E-way bills by wrong procedure.

Kulbir Singh has attached many documents to prove the fake invoices. The documents show that movements of goods never took place within a radius of 5 Kms as the goods were not in the physical possession of the M/s Hartek Power Pvt Ltd. The transporter who transported the goods and issued consignment note/lorry receipt to M/s Hartek Power Pvt Ltd knew that the documents are invalid, wrong, fake and bogus

He said that prima facie the tax invoice and e-way bill and lorry receipt of the transporter are incorrect or false and believed to forged and fake for which investigation is required to be conducted. These tax invoices issued by M/s Hartek Power Pvt Ltd are totally invalid, fake, or incorrect and bogus having false information. The invoices and documents were deliberately prepared with intent to transport taxable goods without a valid cover document in complete knowledge that they are liable to be confiscated under the CGST Act 2017 primarily for the purpose of tax evasion.

He said that transactions made by the supplier company are dubious in nature and tantamount to deceiving him by creating the fake and bogus invoices against the transactions, which are easily traceable by the lay man by going through these documents. He said that being a law abiding and honest taxpayer, he is giving this complaint for taking the immediate serious action on the supplier of the goods, which is registered as a taxable person with the Department.
