CBI COURT SENTENCES THREE ACCUSED TO 3 YEARS IMPRISONMENT IN A BANK LOAN FRAUD CASE

The CBI Court, Ahmedabad, on Tuesday has convicted and sentenced the accused private persons, namely, Balmukund Mithailal Dubey, Dharmesh J. Dhairya and Alpesh Ashwinbhai Thakkar to Three Years Imprisonment with a fine of Rs. 50,000 each, in a bank fraud case. 

The Central Bureau of Investigation (CBI) registered the instant case on 15.12.2009 against Jayesh K. Prajapati and unknown Vijaya Bank Officers/officials. It was alleged that the accused Jayesh K. Prajapati in conspiracy with unknown Vijaya Bank Officers/officials had obtained a housing loan in March, 2004 based on false and forged salary details and his employment related details and submitted false and forged documents related to the Flat in Jalvihar Society. He had obtained a housing loan of Rs.4,78,000. 

Investigation established that the accused Jayesh Prajapati, Alpesh Thakkar, Balmukund Dubey and Dharmesh Dhariya had created false and forged documents and used such documents as genuine in order to obtain bank loan and also opened fictitious account to siphon all such amounts in order to cheat the Vijaya Bank. Investigation revealed that the outstanding amount in the above said loan account is approximately Rs.7,85,109 including the non-paid instalments and interest there on. Hence, there was a wrongful loss to the Vijaya Bank to the tune of Rs.7,85,109. 

After completion of Investigation, CBI filed charge-sheet on 31.12.2010 against the accused Jayesh Keshubhai Prajapati, Balmukund Mithailal Dubey, Dharmesh J. Dhairya and Alpesh Ashwinbhai Thakkar (all private persons). 

The Hon’ble Court, after the trial, convicted and sentenced the accused persons accordingly. 

The case against the accused Jayesh Keshubhai Prajapati, Pvt. Person is separated by the Hon’ble Court as he is absconding since the investigation.
