APPLICATION TO SUSPEND SENTENCE IN BHIM TANK MURDER CASE DISMISSED

The Punjab and Haryana High Court has dismissed the application of Vicky Pandit, one of the 24 convicts in the infamous Bhim Tank murder case, for relief.

Vicky, through his Counsel, filed an application for suspension of sentence claiming that he has undergone 7 years out of the life sentence awarded in the case.

Vicky was named as accused in the gruesome murder of Bhim Tank in December 2015. His first application was dismissed on 24.09.2020 with the condition that he had to complete a minimum three years of sentence from the date of conviction.

The bench of Justice G.S. Sandhawalia and Harpreet Kaur Jeevan said in the recent order that the Counsel (for Vicky Pandit) has tried to convince us that in view of the period undergone, the applicant is entitled for the benefit of suspension of sentence, in view of the law laid down by the Division Bench in Dharam Pal Vs. State of Haryana.

A perusal of the case indicated that a telephonic call had been received from Harpreet Singh alias Harry by Gurjant Singh who had been asked to get the deceased Bhim Tank and come to the Farm House of Shiv Lal Doda, where the compromise would be effected by Amit Doda.

As per the prosecution, two persons had gone to the Farm House and then Bhim Tank and Gurjant Singh had been assaulted by various persons in which the name of Vicky Pandit also figures. Both wrists and feet of the deceased were amputated and he suffered as many as 20 injuries on his body and eventually lost his life.(SUBHEAD)

The bench said, “We are of the considered opinion that the benefit in Dharam Pal case cannot be given a universal role of application and in the manner in which the crime had been committed with planning by calling them at an isolated place at a farm house and by cruelty giving injuries to the deceased, who had been inflicted as many as 20 injuries on his person and it would not entitle the applicant to the benefit of suspension of sentence. Resultantly, we are of the considered opinion that no case is made out for suspension of sentence. However, keeping in view the factum of the undergone period, we are of the view that the appeal can be listed for regular hearing in the month of July, 2023”. EOM
