CBI COURT SENTENCES FOUR ACCUSED TO 8 YEARS RI WITH FINE OF RS. 70 LAKH EACH IN BANK FRAUD CASE OF RS. 6.7 CRORE

The CBI Court Lucknow on Tuesday has convicted and sentenced four private persons namely, Ramji Mishra, Shyamji Mishra, Akhilesh Kumar Mishra, Manishi Pandey and Two Private Firms namely M/s Manishi Enterprises, Varanasi and M/s Mirzapur Carpets Co Ltd in a Bank Fraud case. 

The accused private persons, namely, Ramji Mishra, Shyamji Mishra, Akhilesh Kumar Mishra and Manishi Pandey have been sentenced to Rigorous Imprisonment (RI) for 08 Years with a Fine of Rs. 70 Lakh each. The Court has imposed a fine of Rs. 02 Crore on the firms namely M/s Manishi Enterprises, Varanasi and M/s Mirzapur Carpets Co Ltd (Jointly). 

The CBI registered the instant case on 13.03.2001 against S N Verma, the then Branch Manager, Central Bank of India, Mirzapur and others on the allegations that M/s Mirzapur Carpets Co Ltd. with Ramji Mishra as its Managing Director and Shyamji Mishra and Akhilesh Kumar Mishra as its Directors availed credit facilities from the Central Bank of India, Mirzapur Branch during the Year 1996. 

After completion of investigation, CBI filed a combined charge sheet on 17.03.2004 against 07 accused persons and 02 firms namely S.N. Verma, the then Branch Manager, Central Bank of India, Mirzapur, Yadu Nath Dubey, Pankaj Kumar Tiwari, Manishi Pandey, Ramji Mishra, Shyamji Mishra, Akhilesh Kumar Mishra, M/s Manishi Enterprises, Varanasi through its main Executive Partner and M/s Mirzapur Carpets Co Ltd, Mirzapur through its Managing Director for causing wrongful loss to the tune of Rs. 6.75 Crore to the Bank using forged Bills of Lading.

The Hon’ble Court, after the trial, convicted and sentenced the accused accordingly 

The accused S.N. Verma, the then Branch Manager, Central Bank of India, Mirzapur and Yadunath Dubey (Private Person) have been acquitted from all the charges on the ground that evidence of criminal conspiracy is not found on their part. File has been separated against accused Pankaj Kumar Tiwari by the Hon’ble Court on the medical grounds.
