While taking up the petition filed by the family of Ajay Kumar of Sant Nagar, The Punjab and Haryana High Court today issued notice of Motion to the Punjab government.
Before the bench of Manisha Batra, Advocate SPS Tinna represented the petitioners, Ruchika Sabherwal, Senior DAG, Punjab represented the state.
The petition has been filed by the mother and wife of Ajay Kumar with the request to direct to state government to hand over the investigation of case bearing FIR No.0307 dated 27.09.2026, registered under Sections 109 and 61(2) of BNS, 2023 and Sections 25 and 27 of the Arms Act, 1959 at Police Station City-1 Abohar, to which Section 103(1) BNS was later added, to an independent agency.
The petitioners requested to get it conducted under the supervision of a sitting or retired Judge, on the ground that no action has been taken on the dying declaration/statement of the deceased and also for directing the officials to take action in accordance with the law laid down by the Supreme Court against Shiv Lal Doda, who is named in the dying declaration but has allegedly not been proceeded against due to the political pressure of the ruling party.
The petitioners prayed for directing that the post mortem examination of the deceased Ajay Kumar, whose body has been lying in the mortuary at Civil Hospital, Abohar since 19.10.2026, be conducted by a Board of Doctors from the Post Graduate Institute of Medical Education and Research, Chandigarh or some other reputed institute outside District Fazilka, as the petitioners apprehend foul play at the hands of the local staff of the said hospital.
The State counsel expressed no objection to the prayer of the petitioners for conducting post-mortem of the dead body of the deceased victim at PGIMER, Chandigarh. For other reliefs claimed by the petitioners, the Senior DAG sought time to file a reply. The court adjourned the case to 21.12.2026.
Govt. officials have been directed to arrange for bringing the dead body of the victim to PGIMER, Chandigarh within a period of four days. The Director, PGIMER, Chandigarh has been requested to constitute a Board of Doctors for conducting post-mortem examination of the dead body. Report thereof shall be submitted to the Court on or before the next date of hearing.
