LUCKNOW COURT SENTENCES TWO THEN DISTRICT AYURVED AND UNANI OFFICERS TO THREE YEARS’ IMPRISONMENT WITH FINE OF Rs. 2 LAKH FOR FRAUDULENT PURCHASES

The Ld. Spl. Judge, CBI (Ayurved Scam Case Court), Lucknow has sentenced two accused including Dr. Mahipat Singh, then District Ayurved and Unani Officer (DAUO) of Uttarkashi and Dr. Shyam Lal, then District Ayurved and Unani Officer (DAUO) of Barabanki & Sultanpur to 03 years’ Imprisonment with total fine of Rs. 02 lakh for causing undue loss to the government through dishonest and fraudulent purchases.  

CBI had registered a case on 06.08.1996 in compliance of Order dated 10.07.1996 of Hon’ble High Court at Allahabad. It was alleged that Dr. Shivraj Singh, then Director, Ayurved and Unani Officer, UP Lucknow had a budget of Rs 3,94,35,000/- allotted under the head 06, 25 and 33 but, in larger criminal conspiracy with District Ayurved and Unani Officers (DAUO) of different districts, had issued bogus grant letters/allotment letters for Rs 46 crore and on the basis of such letters DAUOs of different districts raised demand of additional budget grants under the aforesaid heads and purchased medicines and medical equipments & other articles without any actual demand and at much exorbitant rates than the actual market rates, without tenders, thereby causing undue loss to the government. 

Main Chargesheet in the case was filed against Dr. Shivraj Singh and others on 25/02/1997. Subsequently, several Supplementary Chargesheets, including the instant chargesheets, were also filed. During trial except Dr. Mahipat Singh Rawat and Dr. Shyam Lal, the then D.A.U.O, Uttarkashi and Barabanki & Sultanpur respectively, the remaining chargesheeted accused persons expired and case against them was abated. In this case, Rs 70,31,918/- related to Uttarkashi, Rs.54,38,199/- related to District Barabanki and Rs.10,74,647/- related to District Sultanpur were withdrawn dishonestly and fraudulently.  

After trial, the Court held both accused guilty and sentenced them accordingly.
