Punjab and Haryana Highcourt  restrains Election Department, Punjab from appointing Data Entry Operators through outsourcing agency against vacancies created by expiry of tenure of contractual Data Entry Operators:

A Bench of High Court comprising Justice T.S. Dhindsa today restrained the Election Department, Punjab from appointing Data Entry Operators through outsourcing agency against vacancies created by expiry of tenure of contractual Data Entry Operators.

In an application filed on behalf of 53 Proof Readers cum Data Entry Operators, with Sunil Kumar, as main petitioner, it was stated that the Department of Elections, Punjab had relieved 117 Proof Reader Cum Data Entry Operators, including the 53 petitioners, working in the Electoral Registration Officers in the Asssembly constituencies,on contract basis, with effect from 1.3.2017, on expiry of their tenure, despite the existence of vacancies. Responding to their claim for regularization as Data Entry Operators, the Department had stated that although duly sanctioned regular posts were existing, yet those posts would be filled up through direct recruitment, and that petitioners were free to compete with other eligible candidates.

The Counsel for the petitioners stated that now suddenly the Election Department engaged an outsourcing agency namely, Punj Security and House Keeping Services Private Limited, for supplying 117 Data Entry Operators, against the well settled position of law that contractual employees can not be substituted by another set of contractual employees through outsourcing system. The outsourcing agency has supplied a list of 117 candidates who are being allowed to join by the Election Department as Data Entry Operators in the 117 Assembly Constituencies in the offices of District Electoral Officers.

The HC Bench upon hearing the Counsel OF PETITONERS Mr. H.C. Arora, restrained the State Government from appointing Data Entry Operators through outsourcing against vacancies created by expiry of tenure of contractual Data Entry Opewrators, while issuing notices to respondent-State for 28.11.2017.
