HARYANA ISSUED DIRECTIONS REGARDING CONSTRUCTION OF FIRST FLOOR ON SINGLE STORY OF BOOTHS AND SHOPS

Haryana Government has issued directions regarding construction or regularization of first floor on the single storey booths or shops falling in the jurisdictions of Municipalities.

While stating this here today, a spokesman of Urban Local Bodies Department said that these directions would be applicable to all the single storey booths or shops having size 2.75 m X 8.25 m and above, allotted by municipalities

He said that the allottee would have to pay a sum equal to 20 per cent of the collector rates for the fresh construction. For regularization of the already constructed first floor, the fee would be 25 per cent of the collector rate and the allottee would have to get regularize their first floor constructionwithin six months and if the allottee does not get the construction regularized within given time framework then action would be taken as per the law.

The spokesman said that the charges would be payable in lumpsum alongwith request letter. The fee or charges levied for construction of first floor or regularization of first floor on the single storey booths or shops would be spent to upgrade the civic infrastructure of that area.

Before the commencement of the construction, the allottees of single storey shops or booths would get the building plan of first floor sanctioned from the municipality concerned. The building plan would be accompanied with ‘Structural Stability Certificate’ issued by the Registered Structure Engineer and applicant or allottee would also submit an undertaking in the shape of an affidavit to the effect that the allottee would be entirely responsible for the safety of his or her own structure as well as abutting booths or shops. The allottee would also be responsible to make good the loss, if any, sustained by the allottees of abutting booths or shops, municipality or its employees. The first floor on single storey shops or booths would be used ‘for storage purpose’ only, he added.

He said that the permission to raise first floor on single storey shops would also be governed by the terms and conditions as laid in the allotment letter. The applicant or allottee would be bound by the Haryana Municipal Act, 1973 and Haryana Municipal Corporation Act, 1994, regulations, building code, policies and instructions as applicable and amended from time to time. If in case there is more than one allottee, that is, the site is jointly held, then the application would have to be made by all the allottees of that site.

The spokesman said that the application submitted by the allottee would be accompanied by the Occupation Certificate, if already constructed, and would be submitted through the designated persons of the Haryana Building Code-2017 along with the requisite fee as per rules. Allottee would ensure that there is no building violation. If in case it exists, same would be removed before submitting application. Also, the un-allotted single storey shops or booths having size 2.75 m X 8.25 m and above would be auctioned with the provision of first floor to be used for storage purpose only. The reserve price of such un-allotted shops would be fixed accordingly, he added.
