The Special POCSO Fast Track Court here on Thursday has sentenced the convict to death in the heinous rape and brutal murder of a seven-year-old innocent girl in Baddi.
This was the first case of death sentence in Himachal Pradesh under the POCSO Act.
This heinous crime has been termed as rare of rarest nature by the fast track court of Additional District and Sessions Judge Parvinder Singh Arora in Solan. Death orders have been issued to Akash, a resident of Hardoi district of Uttar Pradesh, who was found guilty in raping minor. The learned court sentenced under Section-302, 376 of IPC and Section-10 of POCSO Act. The court also observed that this incident of crime is extraordinary. In this the sentence of life imprisonment would be insufficient.(SUBHEAD)
The court has held that the manner in which the offense has been committed is unusual and the sentence of life imprisonment is insufficient. However, the court has ordered the prosecution to send the entire case to the High Court for verification of the sentence.
The court has sentenced the guilty Akash (23) resident of village Hansolia, PO Sandholi, Tehsil Bilgram, District Hardoi, Uttar Pradesh to death under IPC 302 and Section 6 and 10 of POCSO Act.
According to prosecution the case was registered on 20 February 2017 at Baddi police station of Solan district, Akash committed a heinous crime by taking a seven-year-old girl with him on the pretext of giving crisps and then brutally murdered her.
The court has also ordered the found guilty to pay a fine of Rs 25,000 under section 302 of the IPC. In default of payment of fine, he shall undergo simple imprisonment for six months.
