CBI COURT CONVICTS TWO ACCUSED AMONG THAN DSP TARN TARAN RETIRED AS DIG AND THEN SHO OF POLICE IN EXTRA JUDICIAL KILLING CASE OF PUNJAB

The Special Judge for CBI Cases, Mohali has convicted two accused including Dilbagh Singh, then DSP, City Tarn Taran (retired as DIG) U/s 364 IPC and Gurbachan Singh, then SHO, PS City Tarn Taran (retired as DSP) U/s 302, 364, 201 and 218 IPC in extra judicial killing case of Gulshan Kumar who was alleged to have been illegally detained by Punjab Police on 22.06.1993 from his residence and later killed in a fake encounter on 22.07.1993. The quantum of sentence will be pronounced tomorrow i.e. 07.06.2024.

In compliance of the orders of Hon'ble Supreme Court of India dated 15.11.1995 passed in Criminal Writ Petition No. 497 of 1995 (Mrs. Paramjit Kaur Vs State of Punjab), directing CBI to investigate the matter related to cremation of large number of unidentified dead bodies by Punjab Police, CBI registered PE-2(S)/95/SIU-XV/CHG.

During enquiry, Shri Chaman Lal deposed that his son Gulshan Kumar was abducted by a Police party led by Dilbagh Singh, then DSP City Tarn Tarn on 22.06.1993 from his residence and later killed in a fake encounter on 22.07.1993. The police cremated the dead body of his son at cremation ground Taran Tarn on 22.07.1993 without informing the family members. Accordingly, a case was registered by CBI against Dilbagh Singh, then DSP City Taran Tarn, Amritsar & 04 others on 28.02.1997.

(SUBHEAD)After completion of investigation, chargesheet was filed on 07.05.1999 by CBI against then DSP Dilbagh Singh, then Inspector Gurbachan Singh, then ASI Arjun Singh (expired during the trial), then ASI Devinder Singh (expired during the trial) and then SI Balbir Singh (expired during the trial). The charges were framed against accused persons on 07.02.2000.

After trial, the Court held both accused guilty. A total of 32 witnesses were cited by the CBI. During trial, it has been proved by cogent evidence of eye witnesses that accused persons namely Dilbagh Singh and Gurbachan Singh among others abducted Gulshan Kumar from his house on 22.6.1993, kept him in illegal detention/confinement and subsequently killed him on 22.7.1993.

The evidence presented show that the accused police officers staged the murder as encounter, with testimonies and documents proving the false narratives created by the guilty police officials.
