CBI COURT SENTENCES ACCUSED PARTNER OF A PRIVATE COMPANY TO THREE YEARS’ RI WITH FINE OF RS 60,000/- IN FRAUDULENT DUTY DRAW BACK CASE

The Hon’ble CBI Special Court, Madurai has sentenced accused Sh. C.P. Ramakrishnan then Partner in M/s Trend Settlers to three years’ Rigorous Imprisonment (RI) with total fine of Rs.60,000/- in a fraudulent duty draw back case.

CBI had registered the instant cases on 29.06.2007 against accused including convicted accused on allegations that accused entered a criminal conspiracy at Mumbai, Cochin, Karur and other places, and cheated the Government of India to the tune of Rs. 3,48,29,568/- in the matter of availing duty draw back under the Duty Exemption Entitlement Certificate Scheme (DEEC).

In pursuance of the said criminal conspiracy, accused public servant (then Superintendent of Central Excise, Trichy) by abusing or misusing his official position, issued false examination reports beyond his jurisdiction, Further, on behalf of M/s Sweety International Pvt. Ltd. another accused and Sh. C.P. Ramakrishnan, Partner in M/s Trend Settlers, exported wrinkled and soiled cloth bits having no commercial value, in order to show that they fulfilled the export obligation against Advance License under which textile raw materials were imported to the tune of Rs. 3,54,73,356/- and a duty exemption of Rs. 3,48,29,568/- was availed. 

After completion of the investigation, Chargesheet was filed by CBI on 09.09.2009 against the accused before the Hon’ble Special Court for CBI Cases, Madurai. Accused public servant expired during the trial, hence charges against him were abated. 

The Court, after trial, found accused guilty and sentenced him accordingly.
