CBI COURT SENTENCES THEN ASSISTANT OF NATIONAL INSURANCE CO. SULTANPUR TO FIVE YEARS’ RI, FINE OF RS 55,000/- IN CHEATING & FRAUD

The Ld. Spl. Judge, CBI Court No. 06, Lucknow has sentenced accused Shri Shiv Prasad Gupta, then Assistant of National Insurance Co. Ltd., Sultanpur to five years’ Rigorous Imprisonment (RI) with fine of Rs. 55,000/-in case of cheating by way tampering the account payee cheque to withdraw agency commission.

CBI had registered the instant cases on 22.05.2002 against accused persons including convicted accused. It was alleged that during 2000-01, accused Shiv Prasad Gupta in criminal conspiracy with other unknown accused persons fraudulently converted account payee cheque of agent’s commission into bearer cheque and withdrew the same. Thus, accused caused loss of Rs. 48,826.20/- to the National Insurance Co. Ltd, a Central Govt PSU.

After completion of the investigation, Charge sheet was filed by CBI on 31.07.2004 against the accused.

The Court, after trial, found accused guilty and sentenced him accordingly.
