Economic Offences Wing of Delhi Police has arrested one accused person namely Anil Sethi S/o Late Sh. Mahinder Pal Sethi, R/o F-93, IInd Floor, Rajouri Garden, New Delhi-110027, Age-62 Years in case FIR No. 23/2020, Dt. 30.01.2020, U/s 420/409/120B IPC, P.S Economic Offences Wing, New Delhi for committing cheating with Britannia Industries Private Limited to the tune of Rs. 5.17 Crores.
The present case was registered on the complaint of Ms. Seema Tomar, AR, M/s Britannia, Industries Limited. Complainant company is engaged in the business of manufacturing, marketing, distributing and selling of a variety of bakery products, bread, cakes, rusks, dairy products etc. It has been alleged that M/s Sethi Agencies, a proprietary concern of Mrs. Anju Sethi, having its office at F-93, IInd Floor, Rajouri Garden, Delhi was functioning as a C&F Agent (Carrying & Forwarding Agent) for the complainant since long.
The last agreement executed between the parties was w.e.f 01.09.2018 and pertains to the depot/warehouse located at Mundka, Delhi. As per the agreement, M/s Sethi Agencies as C&F Agent, was entrusted with good manufactured by the complainant for onward sale to various distributors and wholesalers. As per agreement, M/s Sethi agencies was not entitled to use, deal with, dispose of or sell the goods of the complainant in any other manner. During 2018-2019, complaints from different distributors were received regarding unsatisfactory service levels and other defaults of M/s Sethi Agencies. In such circumstances, a decision was taken to transit from M/s Sethi Agencies to a different C&F Agent. Hence a Hand-over Stock Audit was conducted from Ist to 4th Oct, 2019, in the presence of the employees of M/s Sethi Agencies, and it was found that instead of 1,83,765 corrugated boxes of fresh stock that had been entrusted to M/s Sethi Agencies and should have been available at the depot, only 1,21,236 corrugated boxes of fresh stock were found leading to a shortfall of 62,419 boxes worth of stock. Subsequently, details reflected in the damaged and expired stocks as maintained by M/s Sethi Agencies were also verified with stock physically available and a further shortage of 5,344 corrugated boxes was found. During this process, M/s Sethi Agencies had also tendered its resignation as C&F agent. On this, the above mentioned case was registered and investigation was taken up.
Registration of the case:-
During the course of investigation, it has also been revealed that Mrs. Anju Sethi is the proprietor of M/s Sethi Agencies and accused person Anil Sethi was doing all business in the name of his wife Mrs. Anju Sethi. Mrs. Anju Sethi had also issued 03 cheques amounting to 5.17 Crores in the name of the complainant company in lieu of the loss caused to them but the said cheques were also bounced. Various notices were issued in the name of accused Anil Sethi but he didn’t join investigation of the case.
Modus Operandi:-
The accused person had cheated the complainant company by misappropriation of stock items issued in the name of his firm.
On 29.08.22, a raid was conducted at the house of accused Anil Sethi whereas his wife was found present and stated that his husband has gone outside. On this, necessary enquiries were made by watchman of the area and car of the accused was found parked near his house. During further enquiry, it has also been found that accused has installed CCTV Camera’s in house. Due to suspicion, search of accused was made inside the house and he was found hiding in the wooden almirah of his house. Accused has disclosed that he was hiding in the almirah since last 4.5 hours. After this, accused Anil Sethi S/o Late Sh. Mahinder Pal Sethi, R/o F-93, IInd Floor, Rajouri Garden, New Delhi was arrested by the IO Insp Dinesh Malik.
Accused Mr Anil Sethi S/o Late Sh. Mahinder Pal Sethi, R/o F-93, IInd Floor, Rajouri Garden, New Delhi-110027, Age-62 Years is married. He is a B.Com graduate. He has two daughters and both are married. He along-with his wife namely Mrs. Anju Sethi is residing at F-93, IInd Floor, Rajouri Garden, Delhi. Basically he belongs to Kashmir and completed his studies in Kashmir.
He had shifted to Delhi in 1984 and in 1988, he had associated with Brittania Industries and started working as Carrying & Forwarding Agent (C&FA). Thereafter in 2018, he had opened a proprietorship firm in the name of M/s Sethi Agencies and proprietor of the said firm was his wife namely Mrs. Anju Sethi. He was doing his business from the warehouses (02 godowns) of Britannia Industries which was situated at Mundka, Delhi.
